西班牙投资移民新政颁布以来，越来越多的客户来我司询问关于新法的细则和情况。今天KBL加凯移民就律师从西班牙移民局得到的回复，结合专家的意见，对新法细则进行分析：

Article 62.4. The spouse or personwith similar relationship, children under age or offspring of legal age unmarriedand economically dependent on the residence permit holder and dependentascendants, may apply jointly and simultaneously or subsequently, for theauthorization and, if applicable, the visa .

配偶或相类似的关系人，在规定年龄以下或未婚和经济尚未独立的孩子，可以作为附属申请人，同时或随后申请家庭团聚。

专家解读：新法明确了配偶、恋人和孩子作为附属申请人的权利，同时对于申请时间有了更宽松的规定。也就是说无需在主申第一次递交申请时，同时递交家庭团聚申请，在稍后重新递交也成为了可能。考虑到孩子的学业问题，很多家长不希望孩子因为移民而耽误学习，所以这样的规定正适用于在读的孩子。西班牙政府不再要求家庭成员立即去西班牙办理家庭团聚。而是可以选择公共假期或寒暑假去西班牙办理移民相关事宜。

Article 64.Procedureto evidence the investment

If the alien has not completed the acquisition of the propertyor properties but there is a preliminary contract or a promissory agreement(arras) formalized in a public deed, the alien may request a residence visa forinvestors with a duration of 6 months after submitting the promissory agreementjointly with a certificate from a financial institution operating in Spainshowing that the applicant has an escrow account with the outstanding amountsto acquire the property, including the payment of charges and taxes. Thecertificate shall state the deposit should only be used for the purchase of theproperty specified in the preliminary contract.

If the actual purchase of the property or properties is proved,the applicant may apply for a residence visa for investors of one year or aresidence permit for investors in accordance with Article 66.

第64条：投资居留的程序

如果投资人还没有完成购房，但有一个初步的购房合同或承诺买房协议。投资人在进行购房活动后可以要求指定的金融机构出具一份证明，显示其有意愿在西班牙购买规定金额以上的房产，并缴纳税款。这样投资人可以申请一个为期6个月的居留签证用以从事房产买卖或相关事宜。该证明保证此笔金额存于国家制定的金融机构且仅用于购买该物业。

如果目前的物业已购买或已即成事实，申请人可以按照第66条法规申请为期一年的投资者签证。

专家解读：在我们看来，银行存款证明的要求为我们的客户提供了一个更方便更快捷的抵达西班牙的方式，即为期6个月的签证。当然，为期1年的签证同样有效。只不过对于不是很急切去到西班牙的投资者来说，也许意义不大；但对于非常希望立刻登陆西班牙，为孩子读书或今后生活进行安排的人来说，则是一个重大的利好政策。无论6个月还是1年期的签证，这都象征着开放和便捷。因为相比任何旅游签证来说，投资者有了更多的自由。

Article 67. Term of the residence authorization forinvestors

1. The duration of the initialresidence authorization for investors shall be two years.
2. Upon expiry of said term, those foreign investors who are interestedin residing in Spain for a longer period may apply for renewal of the residenceauthorization for investors for a subsequently periods of  five-yearterm, providing  the conditions that generatedthe right to remain in the country.

第67条：居留许可的规定

1.投资者第一次将获得一个为期两年的居留许可，即居留卡。

2.对期望长期生活的这些外国投资者来说，他们可以获得更长时间的居留许可。只要继续持有房产、提供相关证明，随后在申请更新居留卡时可以获得五年期的居留卡。

专家解读：获得当地居留卡是完成移民的标志。但我认为这只是一个起点，一卡在手走遍欧洲，对于居留卡的便利则不用我再多说，但众所周知美好和谐的欧洲生活从此开始。而后延伸到五年一续的居留卡也将是前所未有的创举，提供给我们的投资者多种可选择的生活方式，享受到真正的自由。
